How to File a Consumer Complaint in Telangana

A complete guide to filing consumer complaints in Telangana — jurisdiction, procedure, documentation, and what relief you can expect.

Every day, consumers in Hyderabad and across Telangana deal with defective products, poor services, inflated bills, and misleading advertisements. Most people either accept the loss or spend months chasing call centers with no result. What they may not realise is that India has one of the more powerful consumer protection frameworks in the world — and that filing a formal complaint is simpler and more accessible than it appears.

This guide walks you through the Consumer Protection Act 2019, who it covers, what you can complain about, and the step-by-step process to file a complaint in Telangana.

Who Qualifies as a Consumer?

Under the Consumer Protection Act 2019, a consumer is any person who:

  • Buys goods for consideration (payment), or
  • Avails services for consideration

The definition includes online purchases. If you buy a product on Amazon, Flipkart, or any e-commerce platform, you are a consumer under this Act. The definition explicitly excludes persons who purchase goods or avail services for commercial resale purposes — so a trader buying goods wholesale for resale typically does not qualify.

Importantly, the 2019 Act brought e-commerce consumers explicitly within its ambit, a significant improvement over the earlier 1986 Act.

What Can You Complain About?

The Act recognises the following as valid grounds for a consumer complaint:

  • Defective goods: A product that has a manufacturing defect, is not of the quality promised, or does not conform to its warranty
  • Deficiency of service: A service provider who fails to deliver what was promised — builders, hospitals, travel agents, banks, insurance companies, telecom operators, educational institutions
  • Unfair trade practices: False or misleading advertisements, offering goods without intent to supply, bait-and-switch pricing
  • Restrictive trade practices: Practices that compel consumers to buy goods or services they do not want
  • Overcharging: Charging above the MRP or the price displayed
  • Hazardous goods or services: Products or services that pose a danger to life and safety

Jurisdiction — Which Forum to Approach?

The Consumer Protection Act 2019 restructured the redressal hierarchy based on the value of goods/services and compensation claimed:

For most consumer disputes in Hyderabad — a builder delay, a defective appliance, an insurance claim rejection — the District Commission in Hyderabad is the appropriate forum. The Telangana State Commission sits in Hyderabad.

The territorial jurisdiction follows the place where the opposite party resides, carries on business, or where the cause of action arose.

Limitation Period

Consumer complaints must be filed within two years from the date on which the cause of action arose. Courts have some discretion to condone delay if you can show sufficient cause, but it is always advisable to file promptly. If the seller refused your refund in January, file no later than January two years later.

How to File a Complaint — Step by Step

Step 1: Send a Legal Notice First

Before filing, send a formal written notice to the opposite party by registered post. State the defect or deficiency clearly, give them 15 to 30 days to respond, and specify the relief you want. Keep a copy of the notice and the postal receipt. Courts appreciate this — it shows you tried to resolve the matter before litigating.

Step 2: Prepare Your Complaint

The complaint must contain:

  • Full name and address of the complainant
  • Name, address, and description of the opposite party
  • Facts giving rise to the complaint, chronologically
  • Documents in support
  • The relief sought (refund, replacement, compensation, or all three)
  • Verification by the complainant

Step 3: File on the E-Daakhil Portal

The National Consumer Helpline's e-daakhil portal (edaakhil.nic.in) allows you to file consumer complaints entirely online. This is the most convenient route for most complainants in Telangana.

To file on e-daakhil:

  1. Register on the portal with your mobile number and email
  2. Select the appropriate Commission (District — Hyderabad)
  3. Fill in the complaint form with all party details and facts
  4. Upload supporting documents as PDFs
  5. Pay the prescribed filing fee online
  6. Submit — you will receive a case number

Filing fees are modest: Rs. 200 for claims up to Rs. 5 lakhs, scaling up to Rs. 7,500 for claims at the highest tier of the National Commission.

Step 4: Attend Hearings

After admission of your complaint, the opposite party is served notice and given time to file their response. The Commission then schedules hearings. Consumer forums are designed to be accessible without a lawyer, though engaging one is advisable for complex cases involving large sums or technical evidence.

What Documents Do You Need?

Depending on the nature of your complaint, you will typically need:

  • Purchase proof: Invoice, receipt, order confirmation email, delivery slip
  • Product/service documentation: Warranty card, terms and conditions, service agreement
  • Communication records: WhatsApp messages, emails, complaint tickets, call recordings
  • Evidence of defect or deficiency: Photographs, inspection reports, medical records (for healthcare complaints)
  • Legal notice and postal receipt
  • Identity proof (Aadhaar or PAN)

Mediation Option

The 2019 Act introduced mandatory mediation as a pre-litigation option. At the first hearing, if both parties consent, the Commission may refer the matter to a Consumer Mediation Cell. Mediation is confidential, faster than adjudication, and allows parties to reach a mutually acceptable settlement. If mediation fails, the case returns to the Commission for adjudication.

Types of Relief Available

If your complaint succeeds, the Commission can order:

  • Replacement of defective goods
  • Refund of the price paid, with or without interest
  • Removal of the defect in goods or deficiency in services
  • Compensation for physical, mental, and financial harm suffered
  • Punitive damages in cases of gross negligence or fraud
  • Discontinuation of an unfair trade practice

The Commission can also award compensation for the harassment and mental agony caused by protracted non-resolution — a head of relief that is frequently awarded in Hyderabad cases involving builders and insurance companies.

Appeal Process

If you are dissatisfied with the District Commission's order, you can appeal to the State Commission within 45 days of receiving the order. From the State Commission, a further appeal lies to the National Commission within 30 days. Final revision petitions or writ petitions to the High Court are available in limited circumstances.

Importantly, to file an appeal against a District Commission order, the appellant must deposit 50% of the awarded amount (or such lower amount as the State Commission may order). This discourages frivolous appeals by opposite parties.

Execution of Orders

Getting an order is one thing; enforcing it is another. If an opposite party fails to comply with a Commission order, you can file an execution application before the same Commission. Non-compliance is an offence punishable with imprisonment up to 3 years and/or a fine. This enforcement mechanism has teeth, and builders and insurers in Telangana who ignore Commission orders have been taken to task.

Consumer law in India has grown significantly more effective since 2019. The digital filing portal, the mediation option, and stronger penalties have made this one of the more practical avenues for ordinary people to get genuine relief — without spending years in a civil court.
